Terms of Service

Welcome to Fetch ("Fetch," "we," "us," or "our"), a software service available at gofetch.tech that helps real estate photographers find and reach out to potential clients. These Terms of Service ("Terms") are a legal agreement between you ("you" or "your") and David Varela, operating Fetch (to be transferred to a limited liability company). By creating an account or using Fetch, you agree to these Terms. If you do not agree, do not use Fetch.

1. What Fetch Does

Fetch scans publicly available real estate listing information for the cities you select, uses AI to help identify and prioritize potential agent clients, drafts outreach messages and call scripts, and helps you track your outreach. Fetch is a tool that prepares outreach for you. Fetch never sends any message on your behalf. You review and send every message, call, or email yourself, from your own device and accounts. You are solely responsible for everything you send.

2. Eligibility and Accounts

You must be at least 18 years old to use Fetch. You are responsible for keeping your login credentials secure and for all activity under your account. You agree to provide accurate information when you sign up. We may suspend or terminate accounts that violate these Terms.

3. Your Responsibilities When Using Fetch

You are responsible for how you use the information and tools Fetch provides. In particular, you agree that you will:

• Comply with all laws that apply to your outreach, including anti-spam and telemarketing laws such as the U.S. TCPA, the CAN-SPAM Act, and any state-level equivalents, as well as Do Not Call registry rules.
• Only contact people in a manner permitted by law, and honor opt-out requests ("STOP," "unsubscribe," "do not contact me") promptly.
• Not use Fetch to send bulk automated, harassing, deceptive, or unsolicited communications in violation of any law or platform rule.
• Not misrepresent yourself or your services in outreach you send.
• Use your own phone number, email, and messaging accounts, and comply with the terms of those services (for example WhatsApp, your carrier, your email provider).

You, not Fetch, are the sender of every message. You are responsible for ensuring your outreach is lawful. Fetch provides drafts and information; how you use them is your responsibility.

4. Data and Listing Information

Fetch surfaces information from publicly available real estate listings. We do not guarantee that any contact information is accurate, complete, current, or that any particular agent can be reached. Availability and coverage vary by market and over time. You are responsible for verifying information before you rely on it.

5. Subscriptions, Billing, and Refunds

Fetch may be offered free during an early-access or beta period. When paid subscriptions are enabled:

• Subscriptions are billed on a recurring basis (monthly or as described at signup) through our payment processor, Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• Founding members who were granted a locked promotional rate keep that rate for the life of their account, including after a cancellation or lapse, for as long as these Terms apply. The founding rate is available only to founding members, and founding membership is closed to new sign-ups.
• You can cancel at any time; cancellation stops future renewals. Access continues until the end of your current paid period.
• Refunds. You may request a full refund of your first payment within 7 days of that first charge, once per account, for any reason. That refund is issued automatically and also cancels your subscription immediately, so access ends at that point and nothing further is charged. Refunds usually appear on your statement within 5 to 10 business days, depending on your bank. Outside that 7-day window, payments already made are non-refundable unless required by law, though you may still ask us and we will consider it.
• Prices, plans, and usage limits may change. We will give reasonable notice of changes that affect an active subscription.
• All card data is handled by Stripe. Fetch never receives or stores your full card number.

6. Usage Limits

Your plan includes limits (for example, a number of scans per week and messages per day). We enforce these limits and may adjust them, grant temporary increases, or change plan limits over time. Attempting to bypass or exceed your limits is a violation of these Terms.

7. Service Availability and Changes

Fetch is provided on an "as available" basis, and is currently in active development ("beta"). Features may change, break, or be removed. We may modify, suspend, or discontinue any part of Fetch at any time. We are not liable for any interruption, data loss, or unavailability.

8. Acceptable Use

You agree not to: reverse engineer, copy, resell, or redistribute Fetch or its output as a competing service; attempt to gain unauthorized access to our systems or other users' data; overload or interfere with the service; or use Fetch for any unlawful purpose.

9. Intellectual Property

Fetch, including its software, design, and content we create, is owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable right to use Fetch for your own business while these Terms are in effect. Outreach drafts Fetch generates for you are yours to use in your business.

10. Disclaimers

FETCH IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT FETCH WILL FIND CLIENTS, GENERATE RESULTS, BE ERROR-FREE, OR THAT DATA WILL BE ACCURATE. YOU USE FETCH AT YOUR OWN RISK.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS, ARISING FROM YOUR USE OF FETCH. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO FETCH WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE THREE MONTHS BEFORE THE CLAIM (OR $50 IF YOU PAID NOTHING).

12. Indemnification

You agree to defend, indemnify, and hold us harmless from any claims, damages, or costs (including reasonable legal fees) arising from your use of Fetch, your outreach and communications, or your violation of these Terms or any law, including any claim that your messages, calls, or emails violated anti-spam, telemarketing, or privacy laws.

13. Termination

You may stop using Fetch and delete your account at any time. We may suspend or terminate your access if you violate these Terms or for any reason with reasonable notice. On termination, your right to use Fetch ends.

14. Changes to These Terms

We may update these Terms. If we make material changes, we will notify you (for example, by posting in the app or by email). Continuing to use Fetch after changes take effect means you accept the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be handled in the state or federal courts located in Miami-Dade County, Florida.
